Doctor-D Auto Repair Shop: Terms and Conditions

Welcome to Doctor-D Auto Repair Shop ("we", "our", or "us"). By requesting or accepting our services, you agree to these Terms and Conditions. Please read them carefully.

1. General Information

Doctor-D Auto Repair Shop provides professional automotive repair services, including mobile repair services at customer locations throughout the State of Florida. These Terms and Conditions govern our services, and by using our services, you accept and agree to these terms.

2. Labor Rate

Our standard labor rate is $119 per hour. Charges are based on the time it takes to perform the repair or service, with any additional labor time or cost communicated and approved by the customer before proceeding.

3. Warranty

We offer a 12-month or 12,000-mile warranty (whichever comes first) on parts and labor, as required by Florida’s Motor Vehicle Repair Act (Fla. Stat. § 559.901 et al.). This warranty covers defects in materials or workmanship under normal use.

  • Exclusions: The warranty does not cover damage due to accidents, neglect, misuse, or repairs performed by third parties not authorized by Doctor-D. The warranty will be void if the vehicle is used in a manner not consistent with its intended use.

  • Warranty Claims: You must contact Doctor-D within the warranty period (12 months or 12,000 miles, whichever comes first) to report any issues covered by the warranty. We may require the vehicle to be brought to our shop or the mobile service location for inspection.

  • Warranty Process: If the defect is covered by the warranty, we will repair or replace the part at no additional charge.

4. Mobile Repair Services

Doctor-D provides mobile repair services at your location for your convenience. To ensure safety and compliance with Florida regulations, please ensure that the following conditions are met:

  • Safe Work Environment: The worksite must be free of hazards and comply with Florida's local ordinances. You are responsible for ensuring that the area is clear of obstacles or other dangerous conditions that may interfere with the repair.

  • Permits/Permissions: If the worksite is on a public street, parking lot, or other public area, you are responsible for obtaining any necessary permits or permissions from local authorities. Doctor-D is not responsible for any fines or violations resulting from failure to obtain proper permits.

  • Access and Space: The repair site must allow sufficient space for our technicians to perform their work safely and efficiently. We reserve the right to decline service if the worksite is inaccessible, unsafe, or otherwise unsuitable for repair.

5. Estimates and Approvals

  • Written Estimates: As required by Florida law, we will provide a written estimate before performing any repair work over $150.00. The estimate will detail the nature of the repair, estimated time, and cost of labor and parts.

  • Approval: We will not begin any work until you have reviewed and approved the written estimate. If additional work is required beyond the initial estimate, we will contact you for approval before proceeding.

  • Changes to Estimate: If the final cost exceeds the estimate by $100 or more, we will inform you of the increased costs and obtain your approval before continuing with repairs.

6. Payment Terms

  • Payment Due: Payment for services rendered is due upon completion of the repair, unless otherwise agreed upon. We accept (credit cards, cash, Zelle, checks).

  • Deposit: A deposit may be required for parts or larger repairs. The deposit is non-refundable unless the repair is canceled before work begins.

  • Late Payment: If payment is not made within [3] days of service completion, we may charge a late fee or pursue legal action for collection, in accordance with Florida law.

7. Customer Responsibilities

  • Accurate Information: You agree to provide accurate and complete information regarding the condition of your vehicle, including any known issues or prior repairs. Failure to do so may result in delays or additional charges.

  • Post-Service Care: It is your responsibility to maintain your vehicle and follow any maintenance instructions provided to ensure the validity of the warranty.

  • Unsafe Conditions: You are responsible for providing a safe environment for our technicians to perform the work. If we determine that the worksite is unsafe or violates any Florida safety regulations, we may refuse service, and you may incur a service charge for the trip.

8. Limitation of Liability

  • No Liability for Indirect Damages: Doctor-D is not responsible for any indirect, incidental, or consequential damages resulting from the repair or service, including but not limited to loss of use, income, or damage to other property.

  • Liability Limitation: Our liability for any claims, losses, or damages is limited to the total cost of the services provided under these Terms and Conditions.

9. Severe Weather and Service Delays

Due to Florida's susceptibility to severe weather (e.g., hurricanes, flooding), we may delay or reschedule your mobile repair service for safety reasons. We are not liable for delays caused by weather-related events, and we will make reasonable efforts to inform you of any changes to the scheduled appointment.

10. Cancellation and Refund Policy

You may cancel the repair service at any time before work begins. If work has already started, you will be charged for labor and materials incurred up until the cancellation. Refunds for canceled services will be provided as per the Florida Motor Vehicle Repair Act, and only for services not yet completed or parts not yet used.

11. Privacy and Data Security

We respect your privacy. Any personal or vehicle-related information you provide is used solely to perform our services and will not be shared with third parties except as required by law.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes will be resolved in accordance with Florida's Motor Vehicle Repair Act, and may be subject to binding arbitration under the Florida Arbitration Code (Fla. Stat. § 682). If mediation or arbitration fails, disputes will be heard in the appropriate court in Sarasota, Florida.

Statute of Limitations: Claims must be initiated within 4 years of the incident date, as outlined by Florida law.

13. Modifications to Terms

Doctor-D reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to you either through email or posted on our website. Your continued use of our services after any such changes constitutes your acceptance of the updated Terms and Conditions.
